1. Acceptance & Use of the Site
By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Site. ConeXware, Inc. reserves the right to modify these Terms at any time; modifications take effect when posted on the Site, and your continued use of the Site after posting constitutes acceptance of the modified Terms.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. Prohibited conduct includes:
- Attempting to gain unauthorized access to any portion of the Site, related systems, or networks.
- Interfering with or disrupting the operation of the Site, including by introducing malware or excessive automated traffic.
- Using any robot, scraper, or automated means to access the Site without ConeXware's prior written permission.
- Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
- Using the Site to transmit spam, chain letters, or other unsolicited communications.
2. Accounts
Some Site features (e.g., placing orders, requesting support) require you to provide information about yourself. You agree to provide accurate, current, and complete information when requested, and to keep that information up to date. You are responsible for maintaining the confidentiality of any account credentials and for all activity occurring under your credentials.
ConeXware, Inc. reserves the right to suspend or terminate access where, in its reasonable judgment, account information is inaccurate or use of the account is in breach of these Terms.
3. Purchases & Refunds
Orders placed through the Site are subject to acceptance by ConeXware, Inc. We may decline or cancel orders at our discretion, including where pricing or product information has been published in error. Prices are stated in U.S. dollars (or the regional currency at order time) and exclude applicable taxes unless otherwise noted.
Refund policy
Software licenses are generally non-refundable once delivered, except where required by applicable consumer-protection law. For specific refund requests — including in cases of duplicate orders, technical incompatibility documented during a 30-day trial, or order errors — contact ordering@conexware.com with your order details. Refunds, when granted, are processed to the original payment method.
PowerArchiver Select renewal
PowerArchiver Select maintenance renewals are optional and not auto-renewed. The base perpetual license continues to function whether or not PA Select is renewed. Educational Unlimited subscriptions are annual and require active subscription for the licenses to remain functional — see the Educational Unlimited page for details.
4. Site Content
All content on the Site — including text, graphics, logos, images, software, and the selection and arrangement thereof — is owned by ConeXware, Inc. or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view, download, and print Site content for your personal, non-commercial reference, provided you do not modify the content or remove proprietary notices.
"PowerArchiver" and the PowerArchiver logo are registered trademarks of ConeXware, Inc. Other product and company names mentioned on the Site are the property of their respective owners.
User-submitted content
If you submit comments, support tickets, feature requests, or other content to ConeXware, you grant ConeXware a worldwide, royalty-free, non-exclusive license to use, reproduce, and incorporate such content into PowerArchiver and related materials. You represent that you have the right to grant this license and that the content does not infringe any third party's rights.
5. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CONEXWARE, INC. DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CONEXWARE, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the limitations above may not apply to you.
7. General
Governing law & jurisdiction
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. Any dispute arising under or related to these Terms will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of such courts.
Children's use
The Site is not directed to children under 13, and ConeXware, Inc. does not knowingly collect Personal Information from children under 13. See the Privacy Policy for details.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire agreement
These Terms, together with the Privacy Policy and (for software use) the End User License Agreement, constitute the entire agreement between you and ConeXware, Inc. regarding the Site.
